PRIVACY POLICY OF THE MANUFACTURING-JOURNAL PORTAL

§ 1. General provisions

  1. This Privacy Policy sets out the rules for the processing of personal data and the use of cookies in connection with the operation of the Manufacturing-Journal portal available at www.manufacturing-journal.net.

  2. This Privacy Policy has been prepared taking into account the requirements of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, commonly referred to as the GDPR.

§ 2. Scope of processed data

  1. The Controller may process personal data of Users, company representatives, partners, advertisers, authors, interviewees, subscribers and persons contacting the portal.
  2. Depending on the manner in which the portal is used, the Controller may process the following categories of data:

a) first name and surname,
b) company or organisation name,
c) position or function,
d) email address,
e) telephone number,
f) correspondence address or other company details, if provided,
g) content of correspondence,
h) data concerning interest in cooperation, publication, advertising or other services,
i) technical data related to the use of the portal, such as IP address, cookie identifiers, device data, browser data, operating system data, activity within the service and source of entry to the website.

§ 3. Purposes of data processing

Personal data may be processed for the following purposes:

  1. handling enquiries addressed to the Controller,
  2. conducting correspondence with Users, companies, partners, advertisers and other persons contacting the portal,
  3. preparing, implementing and handling editorial, promotional, advertising or business cooperation,
  4. publishing editorial content, interviews, press materials, company information, sponsored or advertising materials,
  5. pursuing claims or defending against claims,
  6. fulfilling legal, accounting, tax or archiving obligations,
  7. ensuring the security of the portal and preventing abuse,
  8. analysing the use of the portal, improving its functionality and adapting content to recipients,
  9. conducting marketing activities relating to the Controller’s activities, provided that there is an appropriate legal basis for such activities.

§ 4. Legal bases for processing

  1. Personal data is processed in accordance with the GDPR, in particular on the basis of:

a) Article 6(1)(a) GDPR – consent of the data subject, for example in the case of voluntary subscription to a newsletter, consent to a specific marketing contact or consent to selected cookies,

b) Article 6(1)(b) GDPR – processing necessary for the performance of a contract or in order to take steps prior to entering into a contract, for example in the case of an enquiry regarding cooperation, advertising, publication or another service,

c) Article 6(1)(c) GDPR – processing necessary for compliance with a legal obligation to which the Controller is subject, for example tax, accounting or archiving obligations,

d) Article 6(1)(f) GDPR – the legitimate interest of the Controller, in particular conducting correspondence, handling enquiries, own marketing, securing claims, protecting the service and analysing the functioning of the portal.

  1. If processing is based on consent, the data subject has the right to withdraw consent at any time. Withdrawal of consent does not affect the lawfulness of processing carried out before its withdrawal.

§ 5. Recipients of data

  1. Personal data may be transferred to entities supporting the Controller in operating the portal and conducting its activities, in particular:

a) hosting and IT service providers,
b) email service providers,
c) entities providing technical, administrative or organisational services,
d) entities providing accounting, legal, tax or technical advisory services,
e) partners and subcontractors involved in the provision of services, publications, advertising campaigns or editorial activities,
f) public authorities, where the obligation to provide data results from legal provisions.

  1. Data is transferred only to the extent necessary to achieve a specific purpose and on an appropriate legal basis.
  2. The Controller does not sell Users’ personal data.

§ 6. Transfer of data outside the European Economic Area

  1. The Controller aims to process personal data within the European Economic Area.
  2. If, in connection with the use of technical services or tools supporting the operation of the portal, data is transferred outside the European Economic Area, such transfer shall take place only in accordance with the rules provided for in the GDPR, in particular with the application of appropriate legal safeguards.

§ 7. Data retention period

  1. Personal data is stored for the period necessary to achieve the purpose for which it was collected.
  2. Data processed for the purpose of handling enquiries is stored for the time necessary to provide a response and for the period allowing the course of correspondence to be demonstrated or possible claims to be defended.
  3. Data processed in connection with a contract, settlements or tax obligations is stored for the period required by law.
  4. Data processed on the basis of consent is stored until consent is withdrawn, unless there is another legal basis for further processing.
  5. Data processed on the basis of the Controller’s legitimate interest is stored until an effective objection is raised or until that interest ceases to exist.

§ 8. Rights of data subjects

  1. The data subject has the rights provided for in the GDPR, including:

a) the right of access to data,
b) the right to rectification of data,
c) the right to erasure of data,
d) the right to restriction of processing,
e) the right to data portability,
f) the right to object to data processing,
g) the right to withdraw consent, if processing is based on consent,
h) the right to lodge a complaint with a supervisory authority.

  2. The data subject has the right to lodge a complaint with the President of the Personal Data Protection Office if they consider that the processing of their data violates the GDPR.

§ 9. Voluntary provision of data

  1. Providing personal data is voluntary, but it may be necessary in order to use certain functions of the portal, receive a response, establish cooperation, publish material or provide a service.
  2. Failure to provide data may prevent the handling of an enquiry or the performance of a specific action.

§ 10. Automated decision-making and profiling

  1. The Controller does not make decisions concerning Users based solely on automated processing of data that would produce legal effects concerning them or similarly significantly affect them.
  2. The Controller may use analytical or advertising tools that enable analysis of Users’ activity on the portal or adjustment of advertising content, only to the extent compliant with applicable law and with the consent settings expressed by the User.

  1. The portal may use cookies, i.e. small text files stored on the User’s device when using the website.

a) ensuring the proper functioning of the portal,
b) maintaining the security of the service,

d) analysing visit statistics and the manner in which the portal is used,

f) conducting advertising or remarketing activities, provided that the User has given appropriate consent.

  2. These measures may include, in particular, access control, protection of administrative accounts, security of IT systems, use of passwords, software updates, backups and limiting access to data only to authorised persons.
  3. The scope of the safeguards applied corresponds to the nature, scope, context and purposes of data processing.

§ 14. Changes to the Privacy Policy

  1. The Controller reserves the right to amend this Privacy Policy in the event of changes in legal provisions, technological changes, changes in the functionality of the portal or changes in the manner of data processing.
  2. The current version of the Privacy Policy is published on www.manufacturing-journal.net.
  3. Changes shall apply from the date of their publication, unless another date is indicated in the content of the change.
